JRK Residential, one of California’s largest property management companies, oversees more than 3,500 rental units across the state. In recent years, devastating wildfires have swept through Napa and Sonoma counties, destroying thousands of homes and displacing countless families. Amid this crisis, some landlords saw an opportunity for profit by raising rent prices. In California, it is illegal to raise the cost of essential services by more than 10% during declared emergencies. Our lawsuit alleged that JRK Residential violated this “price gouging” law by increasing rents on its California properties by more than 10% during the wildfire-related emergencies. In addition, the suit alleged that JRK imposed illegal liquidated damages fees, further compounding tenants’ financial struggles during an already difficult time.
EKO litigated this novel, state-wide class action lawsuit to protect California tenants from these exploitative practices and to enforce California’s consumer and tenant protection laws. In August 2024, the court granted EKO's motion to certify the case as a class action. This victory was the result of smart tactics, hard-fought litigation, and a steadfast commitment to achieving justice.
