Suddenlink Outages

EKO had to get creative to bring claims against Suddenlink Communications, an internet service provider operating throughout the US, for false and misleading claims regarding its home internet services.

Suddenlink advertised high speed cable television and internet in remote communities. But in many cases, customers lost service for months at a time with no explanation. Entire communities were unable to use their home internet in the height of the pandemic for essentials--distance learning, virtual meetings, even getting the news.​ 

But Suddenlink hid behind an arbitration clause in its contract to keep customers out of court.

 

EKO took action, demanding an injunction to stop the company's deception. When Suddenlink tried to force the case into arbitration, EKO fought back ... and won. After the Eastern District of California court denied Suddenlink's motion to force the case into arbitration, the parties quickly reached a settlement.
