EKO Fights Coinbase Arbitration Agreement

The LexisNexis legal news service Law360 recently featured EKO's Julie Erickson, who argues Coinbase's forced arbitration clause is "patently unfair."


The arguments were filed on November 18, 2022 in the case Donovan v. Coinbase, Case No. 3:22-cv-02826, filed in the Northern District of California, as a part of the plaintiffs' opposition papers to Coinbase's motion to compel the case to arbitration.


Erickson offered context for EKO's position.

"The patently unfair terms imposed by Coinbase infect nearly every facet of the arbitration agreement and demonstrate Coinbase's intent to use arbitration as a weapon against its users and deter them from making claims."
